TERMS OF SERVICE 1. The Client shall reimburse photographer for any additional cost incurred for travel, meals, and other reasonable costs necessary to perform these services. 2. The retainer fee is non-refundable should the client cancel the engagement. If photographer fails to appear at the specified time and location, the retainer fee shall be refunded in full to the Client. 3. The Client Shall assist and cooperate with the Photographer (Jenna Barrett) in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; taking time to pose for photographs at the Photographer’s discretion; pre-shoot consultations; etc. Photographer shall not be responsible for photographs not takes as a result of Clients failure to provide reasonable assistance or cooperation. This includes children who are unwilling or unable to follow directions. 4. The Photographer retains copyright to the photographs and hereby grants the Client unlimited but non-exclusive right to use or reproduce the photographs for which the client pays. Photographs shall be delivered to the client via online file sharing service such as DropBox or any other media deemed suitable by the photographer. 5. Photographer and client will work together on styling, if at time of photoshoot the client does not agree with styling choices made by photographer, the client must informed the photographer at the time of the session in order to edit styling choices to clients satisfaction. Anthem in Art reserves the right to deem any content or styling selection inappropriate and to change or alter styling selections so that they reflect the branding and quality consistent with Anthem in Art’s body of work. 6. Photographer will cull images and carefully choose which images will be enhanced and included in the session cost. Photographer will not show client all images taken at the time of the sessions nor afterward, photographer selects only the best images to be edited. All images chosen by the photographer will be edited to the photographer’s discretion. PLEASE NOTE: Our goal is to always create a wonderful experience for you as well as to provide you with the highest quality images. With that said, there are no refunds for clients not satisfied with the images produced.

Upon receiving the retainer/deposit, Anthem in Art shall reserve the time and date agreed upon. All session fees and retainers are non-refundable, even if the portrait is rescheduled or canceled for any reason other than inclement weather. -If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of Anthem in Art, the photographer may elect to use an alternate location or to reschedule the session. -No images will be taken or edited until the balance is paid in full. -Anthem in Art reserves the right to use images created under this contract for advertising, display, publication or other purposes. The client warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the studio/photographer in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of Anthem in Art

-If Anthem in Art cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer's illness or emergency, then the Photographer shall return any deposit or sitting fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the even that photographic materials are damaged in procession, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event Anthem in Art fails to perform for any other reason, the studio/photographer shall not be liable for any amount in excess of all monies paid.

NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs or videos elsewhere without Anthem in Art’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. It is also illegal to alter the images in any way, this includes the adding or use of filters, adding or removing objects, changing colors, etc.

This Contract incorporates the entire understanding of the parties and is governed by the laws of Texas. Any modifications of this contract must be in writing and signed by both parties. By agreeing below I am stating that I have read and understood this agreement, including the terms and conditions, and agree to be bound by them.
